Cosmetic Surgery Solicitors FAQs
What is the definition of negligence?
Negligence is defined as conduct that falls below the standard of behaviour that has been established by law in order to protect others against the unreasonable risk of harm. Anything below this standard is seen as acting negligently.
A failure to conform to a required standard of conduct or behaviour will form the basis of any claim for negligence, alongside proof that someone was harmed as a result and that negligence was the cause of harm.
Is there a time limit for making a claim?
Yes there is. This stands at three years after you discover that you were the victim of negligence.
However, if the victim of negligence was under 18 when it occurred, the 3 years start from their 18th birthday. If the victim is suffering from mental health issues then the 3 year limit will commence from their recovery.

Do I have to go to court?
A large percentage of negligence cases do not get as far as the court stage. Responsibility is usually admitted long before this, and the claim settled. Early settlements of cases are always preferred. If you do need to go to Court however, please rest assured that we support you on this every step of the way.
What do I need to do to prove I have been the victim of negligence?
It is important that you are able to prove what has happened to you. This will usually take the form of opinion from independent experts who know a large amount about the area in which you are claiming. As their evidence will be vital to your case, it is essential that these experts are well sourced. This is something we will help you with.

The severity of the harm and distress caused to you will also play a part in the level of compensation you receive.
