Ms E underwent breast augmentation in 2020. She was looking to achieve an increase in the size of her breasts and for them to be uplifted, while also correcting asymmetry.
Following her initial operation, Ms E was left with obvious asymmetry in the size and shape of her breasts and the height of her nipples. The uplifted look that she desired had not been created.
She underwent a second surgery with the same surgeon to try and correct the issues. However, the surgeon only performed surgery on one of her breasts, leaving her with ongoing asymmetry and ptosis (drooping). She was advised by the surgeon that nothing further could be done to improve the appearance of her breasts.
Ms E sought a second medical opinion and underwent a third operation with a different surgeon, which achieved her desired results.
Ms E instructed us to represent her. We arranged for an independent plastic surgeon to examine Ms E and prepare a medico-legal report. Our case against the surgeon who performed her first two operations was as follows.
We alleged that Ms E’s surgery was performed negligently as the surgeon failed to inform her:

Prior to the first operation, that uplift surgery, alongside augmentation, was necessary to achieve her desired results; and

Prior to the second operation, she required surgery on both breasts to correct her ongoing asymmetry and ptosis.
Following the commencement of Court proceedings, we successfully settled Ms E’s claim for compensation in the sum of £36,000. Ms E claimed damages for physical and psychological injury; the cost of corrective surgery; psychological therapy; time off work and other miscellaneous losses.
